The limits and fees for a builder claim

Scotland — Simple Procedure up to £5,000, started online via SCTS Civil Online. Claims are started online through the SCTS Civil Online portal (paper Form 3A only with sheriff approval). The respondent gets a timetable; if no Response Form is filed, you must send an Application for a Decision (Form 7A) within two weeks of the response deadline or the claim is dismissed. For consumer contracts, you can generally raise the claim in the court for where you live or where the trader is based.

Finding your hearing venue

The official register is the source of truth: HMCTS Find a Court or Tribunal. Enter the builder's trading address (or your own, for consumer contracts) — the finder returns the court that serves The City of Edinburgh Council and its contact details. Check opening times and appointment rules before travelling.

Before you issue: the two documents that decide it

1. Letter before action — the court expects pre-action conduct; 14 days to respond. 2. Schedule of loss — your number, evidenced line by line.

Report it too

The Citizens Advice consumer service passes reports to The City of Edinburgh Council Trading Standards (council page, verified 2026-09-03). Enforcement and your civil claim run in parallel.
